This policy explains how ClipperFC collects, uses, and protects your personal information in compliance with the Nigeria Data Protection Act 2023.

1. Introduction

ClipperFC ("we", "our", or "us") is committed to protecting the personal information of every creator, brand, and visitor who interacts with our platform. This Privacy Policy explains what data we collect, why we collect it, how we use it, and the rights you have over your information.

By joining our waitlist, using our platform, or visiting our website, you agree to the practices described in this policy. If you do not agree, please do not use our services.

This policy is governed by the Nigeria Data Protection Act 2023 (NDPA) and the Nigeria Data Protection Regulation 2019 (NDPR), as administered by the Nigeria Data Protection Commission (NDPC).

2. Information We Collect

We collect the following categories of personal information:

Information you provide directly: When you join our waitlist or register an account, we collect your full name, email address, account type (creator or brand), and any referral code you use or generate. Brands may also provide a company name.

Information collected automatically: When you visit our website, we automatically collect your IP address, browser type, operating system, referring URL, pages visited, and the time and date of your visit. This information is collected through standard server logs and analytics tools.

Payment information: When you become an active creator on the platform, we collect your Nigerian bank account details (bank name, account number, account name) solely for the purpose of processing payouts. We do not store full card numbers or payment credentials.

Content and usage data: We collect data about the content you submit to campaigns, the views your content generates, and your engagement with the ClipperFC dashboard.

3. How We Use Your Information

We use the information we collect for the following purposes:

To operate the platform: Processing waitlist registrations, managing your account, tracking referrals, calculating earnings, and processing Naira payouts to your bank account.

To communicate with you: Sending waitlist confirmation emails, payout notifications, platform updates, and important announcements. You may opt out of marketing communications at any time.

To improve our services: Analysing usage patterns, identifying bugs, and understanding how creators and brands interact with the platform so we can build better features.

To prevent fraud: Monitoring for fraudulent view activity, bot traffic, and abuse of the referral system to protect the integrity of the platform and the earnings of legitimate creators.

To comply with legal obligations: Maintaining records as required by Nigerian law, including the NDPA 2023, the Companies and Allied Matters Act, and applicable tax regulations.

4. Referral Programme and Leaderboard

Our waitlist leaderboard publicly displays the first name and partially masked email address of participants, along with their referral count and ranking. By joining the waitlist, you consent to this limited public display.

Your unique referral code is personal to you. If you share it, anyone who uses it will be attributed to your referral count. We are not responsible for how you choose to share your referral link.

Referral prizes are awarded to the top three referrers at the time of platform launch. ClipperFC reserves the right to disqualify any participant found to have used fraudulent, automated, or deceptive means to generate referrals.

5. Sharing Your Information

We do not sell, rent, or trade your personal information to third parties. We share your data only in the following limited circumstances:

Service providers: We work with trusted third-party providers for email delivery, analytics, cloud hosting, and payment processing. These providers are contractually obligated to handle your data securely and only for the purposes we specify.

Legal requirements: We may disclose your information if required to do so by law, court order, or a valid request from a Nigerian regulatory authority, including the NDPC, the Central Bank of Nigeria (CBN), or law enforcement agencies.

Business transfers: In the event of a merger, acquisition, or sale of ClipperFC, your information may be transferred to the acquiring entity, subject to the same privacy protections described in this policy.

With your consent: We will share your information with third parties in any other circumstances only with your explicit prior consent.

6. Data Retention

We retain your personal information for as long as your account is active or as needed to provide you with our services. If you request deletion of your account, we will delete or anonymise your personal data within 30 days, except where we are required to retain it for legal or regulatory compliance purposes.

Waitlist data is retained until the platform launches and accounts are migrated. If you do not activate your account within 12 months of launch, your waitlist data will be deleted.

7. Your Rights Under the NDPA 2023

As a data subject under the Nigeria Data Protection Act 2023, you have the following rights:

Right of access: You may request a copy of the personal data we hold about you at any time.

Right to rectification: You may request that we correct any inaccurate or incomplete personal data.

Right to erasure: You may request that we delete your personal data, subject to our legal retention obligations.

Right to data portability: You may request that we provide your personal data in a structured, machine-readable format.

Right to object: You may object to the processing of your personal data for direct marketing purposes at any time.

Right to withdraw consent: Where processing is based on your consent, you may withdraw that consent at any time without affecting the lawfulness of prior processing.

8. Cookies and Tracking

Our website uses essential cookies to maintain your session and ensure the platform functions correctly. We do not use advertising cookies or cross-site tracking cookies.

We use privacy-respecting analytics to understand aggregate traffic patterns on our website. This analytics data does not identify individual users and is not shared with third parties for advertising purposes.

You may disable cookies in your browser settings, but this may affect the functionality of certain parts of our platform.

9. Security

We implement industry-standard security measures to protect your personal information, including encryption of data in transit (TLS/HTTPS), encrypted storage of sensitive data, access controls limiting who within our team can view personal data, and regular security reviews of our infrastructure.

However, no method of transmission over the internet is 100% secure. While we strive to protect your data, we cannot guarantee absolute security. In the event of a data breach that affects your rights and freedoms, we will notify you and the NDPC within 72 hours as required by the NDPA 2023.

10. Children's Privacy

ClipperFC is not intended for use by individuals under the age of 18. We do not knowingly collect personal information from minors. If we become aware that we have collected data from a person under 18 without parental consent, we will delete that information immediately. We may update this Privacy Policy from time to time to reflect changes in our practices, technology, or legal requirements. When we make material changes, we will notify you by email and by posting a prominent notice on our website at least 14 days before the changes take effect. Your continued use of the platform after the effective date constitutes acceptance of the updated policy.
